Expert witnesses are called upon in the court system to serve as an objective party to the lawsuit and never function as an advocate for one side or the other. Expert witnesses are present in litigation to explain complicated scientific issues, not to influence the jury or judge with fervor. The main responsibilities of expert witnesses are to evaluate potential problems, defects, deficiencies, or errors only when able to fully appreciate a process or system.

Expert witnesses are obligated to study the processes prior to making a survey or postpone the assignment prior to potentially missing the target due to lack of specific condition understanding. They are called to testify under the assumption that all the preparation required for a competent evaluation of the process has been made.

Federal Rules of Evidence – Rule 702. Testimony by Expert Witness

A witness who is qualified as an expert by knowledge, skill, experience, training, or education may testify in the form of an opinion or otherwise if:

(a) the expert’s scientific, technical, or other specialized knowledge will help the trier of fact to understand the evidence or to determine a fact in issue;

(b) the testimony is based on sufficient facts or data;

(c) the testimony is the product of reliable principles and methods; and

(d) the expert has reliably applied the principles and methods to the facts of the case.

Dr. S. Ebow Coleman, Ph.D., P.E.

Dr. S. Ebow Coleman, Ph.D., P.E. is President & CEO of C3S, Inc., a concrete consulting engineer firm in Houston, Texas. With over 30 years of experience in the concrete and construction materials industry, Dr. Coleman’s has extensive experience in condition assessments and forensic evaluation of damaged structures. 

Dr. Coleman often performs due diligence for property managers and owners on various projects and also offers expert witness testimony on construction litigation cases. He has written several proprietary research papers and co-authored two US patents. His specialization in forensic evaluations of concrete has been invaluable in resolving problems involving ready-mix concrete plants, facility maintenance, airport runways, highway pavements, commercial buildings, industrial structures, and educational facilities.

Dr. Coleman is the founding member and first president of the Houston Chapter of  the International Concrete Repair Institute (ICRI). Through his firm C3S, Inc. Dr. Coleman aims to “Build quality up-front into his client’s construction projects in order to reduce the high repair and maintenance costs”.
